  • Based on CDC’s Interim guidelines, antibody test results “should not be used to make decisions about returning persons to the workplace”. Antibody tests do not meet the ADA’s “job related and consistent with business necessity”. Therefore, antibody tests are not allowed for employees to re-enter the workplace. Recommendations for High-Risk States.

In yesterday’s (June 17) Recommendations for Business, we began a discussion of the current COVID-19 risk status of states across the nation, TAG’s data analytics, and our recommendations. Today, we continue that discussion, providing more detail and specifying states where current increases in cases indicate the need for continued protections.

 

Based on TAG’s analysis of U.S. data from reliable and scientific sources (as detailed in the table below), we see Alaska, Arkansas, Arizona, California, Florida, Oregon, and South Carolina as states where there has been a three-week increase in the percentage of positive tests compared to the percentage increase in total testing. Recently, some have stated that the increase in case counts are a function of increased testing while these data tell a different story.

With these analytics showing that COVID-19 is still very much present, TAG recommends that all businesses ensure any reopening and rebounding during the pandemic is being conducted responsibly, and that those businesses with operations in these high-risk states put particular emphasis on employee protections, communicating the risk with all workers, and emphasizing off-duty social distancing and mask wearing.

 

We also recommend against non-essential travel to these states, both business and personal. And that all TAG and CDC travel recommendations continue to be followed.
